Over 37,000 Pennsylvania residents are registered to use medical marijuana. Chances are, at least one of these patients will reside in your long-term care facility and want to use their marijuana medication. How are you going to respond to this scenario without putting your facility at legal risk? In an era of legalized medical marijuana use in Pennsylvania, how can a healthcare provider remain in compliance with Federal law while respecting a resident's right to use the drug?

Objectives:

  1. Learn how to protect their facility’s Federal licensure/certification and reimbursement in a new era of legal Medical Marijuana in Pennsylvania.
  2. Identify how healthcare providers in other states have regulated medical marijuana use in their facilities.

Speaker:

Mr. Natirboff started as an associate with the firm at its inception in 1997. Now a partner at Capozzi Adler, P.C., he is the chair of the Reimbursement Litigation Department which, at any time, handles over 500 Administrative Appeals and Civil Actions. Since the founding of the firm, Mr. Natirboff has successfully resolved over 1,000 Medicaid and Medicare reimbursement appeals on behalf of our clients. He also focuses his practice on Medicaid licensure, certification, and bed transfers. Mr. Natirboff's other experience includes employment with the PA Liquor Control Board and the United States Department of State at the American Embassy in Moscow.

Mr. Natirboff has participated in the Dauphin County Pro Bono Program and the Federal Pro Bono Attorney Program for the Middle District of Pennsylvania where he has represented indigent litigants in State and Federal Court, including Federal Jury trials. He came to Capozzi Adler, P.C. from the Pennsylvania Department of Public Welfare where he was employed as an Attorney Hearing Officer, conducting formal hearings and drafting adjudications in the area of Medical Assistance.

Mr. Natirboff is admitted to practice before Pennsylvania State Courts, the United States District Court for the Middle and Western Districts of Pennsylvania, and the Third Circuit Court of Appeals. Mr. Natirboff successfully argued Christ the King Manor v. Secretary, Department of Health and Human Services, 730 F.3d 291 in the Third Circuit Court of Appeals, where a DHS State Plan amendment imposing the Budget Adjustment Factor on nursing facility providers was declared invalid. Having authored articles on legal issues relevant to nursing home providers, he has been published in Nursing Home Trade Association publications nationally, including LeadingAge PA'‘s legal briefs. With his expertise in long-term care issues, Mr. Natirboff frequently speaks at seminars focused on that topic.
